TUITION & TEACHER TERMS
DEFINITIONS
At DrummerGallop.com and West Hampstead Drum Lesson’s all of our Teachers are registered as self-employed and Enhanced DBS checked. The Teachers operate under an agreement whereby DrummerGallop.com and West Hampstead Drum Lesson’s has been appointed to act as an Agent to facilitate bookings and lessons payments on behalf of the Teachers on an individual agreement basis.
A contract for music lessons are solely between the Student/Parent/Guardian and the Teacher. It is the responsibility of the Teacher to provide the tuition to the student and it is the responsibility of the Student/Parent/Guardian to pay the Teacher for their services.
Throughout these Terms and Conditions the following definitions will apply:
“Student/Parent/Guardian”: The person who is responsible for the payment of Lessons booked between the Student(s) and their Teacher(s)”;
“Student”: The person who is taking the Lessons (maybe the same person as the Student/Parent/Guardian*);
“Teacher”: The party responsible for the delivery of Lessons booked between the Student/Parent/Guardian and Teacher.
LESSON BOOKINGS
Lessons booked through DrummerGallop.com and West Hampstead Drum Lesson’s via the Student Portal are sold by the Teacher.
DrummerGallop.com and West Hampstead Drum Lesson’s have been authorised to facilitate the purchase and booking of music tuition on behalf of the Teachers.
The scheduling of lessons is the responsibility of the Teacher and the Student/Parent/Guardian and not that of DrummerGallop.com or West Hampstead Drum Lesson’s.
LESSON FEES
Any and all lesson fees will be discussed and agreed upon before any lesson(s) is booked.
All agreed fees will sent in writing before your first lesson via the Student Portal‘s lesson reminder email and/or SMS text message.
All Lesson fees are subject to change at the DrummerGallop.com‘s and West Hampstead Drum Lessons discretion.
All prices on DrummerGallop.com are subject to change without notice.
Whilst DrummerGallop.com make every effort to provide customers with the most accurate and up-to-date information, occasionally, one or more items on DrummerGallop.com’s website may be mis-priced. In the event a product is listed at an incorrect price, DrummerGallop.com and West Hampstead Drum Lesson’s shall have the right to refund any orders placed for drum lesson vouchers or drum lesson offers listed at the incorrect price.
PURCHASING LESSON VOUCHERS AND OFFERS
- Lesson vouchers can only be redeemed within West Hampstead Drum Lessons or DrummerGallop.com.
- Lesson vouchers should be treated like cash. They cannot be replaced if lost or stolen.
- Lesson vouchers cannot be exchanged for cash and are non-returnable or transferable.
- Vouchers which are defaced, altered or cancelled will not be accepted.
- Vouchers must be used by the expiration date.
- The cash value of any Lesson vouchers is 0.0000001p
- Only one voucher may be redeemed per person.
- Lesson store offers are only to be used by new customers and
- Lessons store offers can not be block booked.
- Lessons store offers are only available once per customer.
- We reserve the right to change the Terms and Conditions of the vouchers and website offers at any time.
Customers have 7 days in which to cancel a purchased Lesson Gift Voucher or Lesson Shop Offer. After 7 working days have passed, vouchers will be non-refundable and/or non-transferable.
To cancel an order, you must advise us in writing.
If sending a letter please write to us at: 24 Cotleigh Road, Ground Floor Flat, West Hampstead, Camden, London, NW6 2NP and send the letter by recorded post, this is so will have proof of postage. If you wish to cancel your order by email, customers can email us at – andrew@drummergallop.com
If you wish to report non-delivery of your Gift Voucher but would still like to receive the voucher, please call us on +44 (0) 7891 053 752 or email us on andrew@drummergallop.com and we will be happy to re-issue a replacement Lesson Gift Voucher. You must destroy any original vouchers should it be delivered at some later stage since it will have been voided on our systems and will not be redeemable.
REFUNDS
Any Lessons that are cancelled with less than 48 hours notice by the Student/Parent/Guardian are to be charged in full and will not be eligible for a refund as per these terms (See ‘CANCELLATION POLICY’ below).
Refunds or ‘Make Up’ credits will not be given for lessons missed by students.
Every effort will be made to make up missed lessons at a time that is suitable for both the Student and the Teacher, within a strict 7 day period.
Refunds may be issued entirely at the discretion of individual Teachers.
Lesson payments cannot be transferred or sold to another individual.
CANCELLATION POLICY
Lesson dates, times, frequency and duration are agreed upon between the Student/Parent/Guardian and the Teacher. On occasion, it may not be possible for a Student to attend a lesson that a Student/Parent/Guardian have booked with a Teacher.
By using DrummerGallop.com and the Student Portal, the Student/Parent/Guardian agrees to a strict and non-negotiable cancellation policy of 48 hours notice.
If a lessons is cancelled before the 48 hours deadline. A lessons can be cancelled directly by the Student/Parent/Guardian from within the Student Portal. The teacher will be automatically notified.
It is not possible to cancel a lesson from within the Student Portal once the 48 hours cancellation deadline has passed.
If a Student/Parent/Guardian cancels with less than 48 hours notice the Teacher reserves the right to charge the full Lesson amount.
If a Student/Parent/Guardian cancels a Lesson with over 48 hours notice, no payment will be due.
A Student/Parent/Guardian can rearrange their lesson with the a Teacher for if there is a ‘make up’ slot available in the Lesson Calendar of their Student Portal.
We acknowledge that a Teacher has the right to waive the cancelation policy deadline at their own discretion. Teachers have full discretion over this process.
MISSED LESSONS
It is the responsibility of the Student/Parent/Guardian to inform Us as soon as possible of any lessons that a Student will not be able to attend.
Refunds or ‘Make Up’ credits will not be given for lessons missed by students, for any reason.
Teachers may offer an alternative lesson time and day in the form of a ‘Make Up’ credit.
‘Make Up’ credits may be used to book ‘Make Up’ lesson slots via the Student Portal‘s calendar.
‘Make Up’ credits are not a replacement for the following week’s lesson.
‘Make Up Credits’ can not be refunded for cash or credit.
If a Student/Parent/Guardian books a ‘Make Up’ lesson outside of the agreed upon day and time. A students regular lessons day and time will remain the same the following week.
If it is not possible to rearrange a cancelled lesson, any cancellation fees due will still apply to a Student/Parent/Guardian account.
TERMINATION OF LESSONS
To permanently terminate lessons with us, please email your Teacher or fill out the contact form on our website with the subject line – ‘Lesson Termination – (Student Name)’.
It is important for a Student/Parent/Guardian to send a written notice of termination in the form of an email so that there is proof of written communication between both parties.
Failure to notify a Teacher or DrummerGallop.com in the correct manner will result in payment being required for the following month and lessons.
No lessons can be refunded at any time.
INVOICING & PAYMENT FACILITATION
DrummerGallop.com and West Hampstead Drum Lessons charges and invoices for lessons post-taken.
If a Pupil has taken or missed lessons without proper notice (See Above ‘CANCELLATION POLICY, ’MISSED LESSONS’ & ‘TERMINATION OF LESSONS’) during a month, the Student/Parent/Guardian will automatically be issued an invoice for lessons taken that month on the 1st of the following month.
For example: If a lesson or lessons have been taken between the 1st of May and 31st of May. An invoice will automatically be generated and emailed on the 1st of June. The invoice will be sent to the selected preferred ‘Invoice Recipient’ in your Student Portal account.
Any outstanding payments from previous months that have not been settled will also be added to the invoice.
A Teacher reserves the right to not book further lessons with a Student/Parent/Guardian until any outstanding fees have been paid and settled in full.
Bank Transfers and Cash payments are permitted, either at the end of the month, once your invoice for all lessons taken that month has been received. It is also possible to pay by credit/debit on the day of the student’s lesson.
If a bank transfer has been made, the Student/Parent/Guardian must immediately inform their Teacher so that the payment can be properly recorded.
All major credit and debit cards are accepted.
Card payments in-person are processed by SquareUp.
The preferred method of payment for lessons is AutoPay.
Student/Parent/Guardian’s using AutoPay will incur a small convenience fee of 2.4% taken by Stripe. The convenience fee is subject to change at any time.
AutoPay payments are processed through Stripe. You can set up AutoPay in your Student Portal account provided to you during lesson signup.
Setting Up Auto Pay: Login and find the ’Account & Invoices’ section and select ‘Manage Payment Methods’ where you can add your payment details. Lesson payments will be charged automatically at the end of each month after an invoice of lessons taken has been provided to the User. Payments will be taken from your designated card. You can change the payment method in the student portal under the ‘Account & Invoices’ section at any time.

FAILED AND LATE PAYMENTS
Any outstanding payments from a previous months invoice that have not been settled will be added to the next months invoice until those lessons payments have been settled.
Late payments or failure to pay invoices within 30 days of an invoice being issued will see that invoice subject to Late Payment Fees.
All invoices issued through DrummerGallop.com or West Hampstead Drum Lessons fall under the jurisdiction of UK Law.
UK Laws entitle business owners to charge their client(s) compensation charges to recover the late payment of invoices.
Late Payment Fees are subject to “statutory interest,” which is set by the government and is currently set at 8% above above the Bank of England’s current base lending rate.
After 30 days have passed a new invoice will be issued to the Student/Parent/Guardian with the updated Late Payment Fees.
Late Payment Fee Example
If a Student/Parent/Guardian owes £1,000 and the Bank of England base rate is were 0.5%:
- The annual statutory interest on this would be £85 (1,000 x 0.085 = £85)
- Divide £85 by 365 to get the daily interest: 23p a day (85 / 365 = 0.23)
- After 50 days this would be £11.50 (50 x 0.23 = 11.50)
All invoices issued must be paid within 30 days of their issue date. By using and booking lessons through DrummerGallop.com or West Hampstead Drum Lessons the Student/Parent/Guardian agrees to pay upon all invoices within the 30 day time frame. If payments are missed for any reason the invoice is subject to the agreed Late Payment Fees.
A Teacher reserves the right to not book further lessons with a Student/Parent/Guardian until any outstanding fees have been paid and settled in full.
If a Student/Parent/Guardian is using the preferred payment method of AutoPay set up in the Student Portal and an invoice payment fails, the Student/Parent/Guardian will be emailed and/or SMS messaged and be prompted to make the necessary updates to their card details.
Payment for lessons is the responsibility of the Student/Parent/Guardian and not of DrummerGallop.com or West Hampstead Drum Lessons. We are not responsible for any failed payments. This also includes Teachers still providing lessons to Student/Parent/Guardian when payments for previous months lessons have not been settled or are still being retried or processed.
USER/STUDENT DATA
All Student/Parent/Guardian data is stored securely. You may request the removal of your personal data from our systems at any time. All requests will be processed within 30 days. TEACHER TERMS
LESSON BOOKINGS
Lessons booked through DrummerGallop.com and West Hampstead Drum Lesson’s via the Student Portal are sold by the Teacher.

TEACHER SERVICE FEES AND LESSON FEES
DrummerGallop.com and West Hampstead Drum Lesson’s charge Teachers a Service Fee.
Teacher Service Fee’s cover a number of different cost incurred by DrummerGallop.com and West Hampstead Drum Lesson’s such as but not limited to Adverts, Website Hosting, Student Portal Costs, Utilities, Internet, Rent, Equipment and Building Maintenance.
Teacher Service Fees and Lesson fees are agreed upon on an individual basis between DrummerGallop.com and West Hampstead Drum Lesson’s.
Teachers agree to confirm that individual Student Lesson Fees are correct for each Student in the Student Portal before any payment can be requested on their behalf.
Teachers Service Fees may be subject to change at any time. DrummerGallop.com and West Hampstead Drum Lesson’s will endeavour to communicate with Teachers with 30 days notice prior to any changes taking effect.
Teachers owed Lessons Fees will be paid once all outstanding invoices and charges have been collected by DrummerGallop.com and West Hampstead Drum Lesson’s and a Student/Parent/Guardian invoice has been fully settled.
Lesson Fees will be paid in full to a Teacher once their agreed Service Fee has been deducted.
DrummerGallop.com and West Hampstead Drum Lesson’s will pay all Teachers Lesson Fees to a dedicated bank account provided by the Teacher.
Teachers working for DrummerGallop.com and West Hampstead Drum Lesson’s are self-employed and are responsible for paying their own Income Tax and National Insurance contributions on their income.
It is important for all Teachers to keep the appropriate records of all of their income they have received.
DrummerGallop.com, West Hampstead Drum Lesson’s and Andrew Gallop hold no responsibility for Teachers not keeping adequate records or paying their appropriate taxes.
REFUNDS
Any Lessons that are cancelled with less than 48 hours notice by the Student/Parent/Guardian are to be charged in full and will not be eligible for a refund as per these terms (See ‘TEACHER CANCELLATION POLICY’ below).
Any Lessons that are cancelled with less than 48 hours notice by the Teacher must be refunded immediately. If a lesson has been prepaid for a ‘Make Up’ credit must be issued and an alternative date and time agreed upon between the appropriate Student/Parent/Guardian and Teacher. (See ‘TEACHER CANCELLATION POLICY’ below).
Refunds or ‘Make Up’ credits will not be given for lessons missed by students.

If a lesson is missed by a Teacher and an alternative lesson date and time can not be agreed. A refund will be issued to the Student/Parent/Guardian’s preferred Student Portal payment method. No cash will be given.

By using DrummerGallop.com and the Student Portal the Student/Parent/Guardian agrees that a Teacher reserves the right to cancel a lesson at anytime without notice.
If a Student/Parent/Guardian cancels with less than 48 hours notice the Teacher reserves the right to charge the full Lesson amount.
If a Student/Parent/Guardian cancels a Lesson with over 48 hours notice, no payment will be due.
A Student/Parent/Guardian can rearrange their lesson with the a Teacher for if there is a ‘make up’ slot available in the Lesson Calendar of their Student Portal.

TERMINATION OF LESSONS

EAR PROTECTION
Teachers, Students and any other person entering a music studio hereby acknowledges that the Noise at Work Regulations 1989 have established that prolonged exposure to high noise levels above 85 dB(A) may cause damage to hearing and that both studios and studio users are required by law to keep exposures as low as reasonably practicable and that accordingly:
Disclaimer of Responsibility
Due to the nature of music tuition and recording studios, there may be occasions during lessons and recording sessions when recommended listening levels are exceeded. This advisory warning serves to inform users, including Teachers, Musicians, Parents, Guardians, Guests, and Students, of potential risks associated with exposure to loud music and sound.
Assumption of Risk
By accessing or participating in music tuition or recording sessions provided by DrummerGallop.com, West Hampstead Drum Lessons and Andrew Gallop, you acknowledge and accept that the company and its representatives bear no responsibility for any hearing loss or injury that may occur as a result of such activities. It is understood that the volume levels and sound intensities in these sessions may exceed recommended limits and could potentially pose risks to hearing health.
Recommended Precautions
To minimise the risks associated with loud music exposure, we strongly advise all individuals involved in music lessons or present in a studio environment to wear industry-standard ear plugs or ear defenders. These protective devices are crucial for preserving hearing health and reducing the potential for hearing damage. DrummerGallop.com, West Hampstead Drum Lessons and Andrew Gallop encourage all users to prioritise their well-being by adhering to these safety recommendations.
Personal Responsibility
By engaging in music tuition or entering a studio environment, all individuals, including Teachers, Musicians, Parents, Guardians, Guests, and Students, assume personal responsibility for their own health and safety. It is essential to assess one’s personal tolerance for loud sounds and take necessary precautions to protect hearing. DrummerGallop.com, West Hampstead Drum Lessons and Andrew Gallop shall not be held liable for any failure to comply with recommended safety measures or any resulting consequences.
Independent Professionals
Teachers and Musicians associated with DrummerGallop.com or West Hampstead Drum Lessons are independent professionals responsible for their own actions and adherence to safety practices. They are expected to follow industry standards and exercise due care to ensure the well-being of their students or clients. DrummerGallop.com, West Hampstead Drum Lessons and Andrew Gallop shall not be held responsible for any actions or omissions of these independent professionals.
Indemnification
By using the services provided by DrummerGallop.com, West Hampstead Drum Lessons and Andrew Gallop, you agree to indemnify, defend, and hold harmless the company and its representatives from any claims, liabilities, damages, or expenses arising from your participation in music tuition or recording sessions, including but not limited to hearing loss, injuries, or any other related harm.
INSURANCE
A copy of our Public Liability Insurance can be obtained by request.
CHANGES TO THE TUITION TERMS AND CONDITIONS
DrummerGallop.com keeps our Tuition Terms and Conditions under regular review. Any updates will appear on this page.
Modifications
DrummerGallop.com, West Hampstead Drum Lessons and Andrew Gallop reserve the right to modify or update these terms and conditions at any time without prior notice. It is your responsibility to review the terms periodically to ensure you are aware of any changes.
By accessing or using the services provided by DrummerGallop.com, West Hampstead Drum Lesson’s and Andrew Gallop, you signify your understanding and agreement to these tuition terms and conditions.
If you do not agree with any part of these terms, please refrain from using the website and its services.
