4. Drum Tuition and Educational Services

We provide information about drum lessons and other music education services through our website.

Lesson bookings, payments, cancellations, make-up credits and ongoing teaching arrangements are governed by our separate Tuition Terms & Conditions.

These are available at:

https://www.drummergallop.com/tuition-terms/

Our tuition arrangements may include individual lessons, trial lessons and other teaching services offered from time to time.

Where there is any inconsistency between these general website terms and the Tuition Terms & Conditions concerning a lesson booking, the specific tuition terms will normally apply, subject to statutory consumer rights.

Any additional conditions for particular educational services will be explained before booking.

5. Products and Merchandise

Our website may offer physical products, including:

  • T-shirts and other clothing.
  • CDs, vinyl records and other physical music formats.
  • Accessories and merchandise.
  • Printed educational resources.
  • Other products offered through our online shop.

We aim to provide accurate product descriptions, photographs, prices and availability information.

However, minor differences in appearance, colour or packaging may occur.

Product images are intended to represent the item being sold, but colours may vary slightly depending on screen settings.

We will make customers aware of any material product differences before completing an order wherever reasonably possible.

All products are subject to availability.

6. Prices, Orders and Payments

6.1 Prices

Product prices will be displayed in pounds sterling (GBP), unless otherwise stated.

Any applicable taxes, delivery charges and additional fees will be explained before an order is placed.

We reserve the right to correct genuine pricing errors.

Where an error affects an order that has already been submitted, we will contact the customer and offer the opportunity to accept the corrected price or cancel the affected order for a refund.

6.2 Placing an order

When placing an order, customers must provide accurate contact, delivery and payment information.

Submitting an order constitutes an offer to purchase the selected products.

An automated acknowledgement confirms that we have received the order but does not necessarily mean that we have accepted it.

A contract for the purchase of physical products is formed when we send an order acceptance or dispatch confirmation, unless a different acceptance point is clearly stated during checkout.

Payment may be taken before acceptance. If we cannot accept an order, any payment collected for that order will be refunded.

6.3 Payment methods

We may accept payment through secure third-party payment providers.

Available payment methods will be displayed during checkout.

We do not intentionally collect or store full payment-card details on our own systems where transactions are handled by an external payment processor.

Payments may be subject to additional security checks operated by the payment provider.

6.4 Order availability

If an ordered product becomes unavailable, we will contact the customer to discuss an appropriate alternative or refund.

We will not substitute a materially different product without the customer’s agreement.

7. Shipping and Delivery

7.1 Order fulfilment

Physical orders may be packaged and dispatched directly by West Hampstead Drum Lessons.

We may also use third-party printing, manufacturing or fulfilment services.

Regardless of the fulfilment method, we remain responsible for our contractual obligations to customers purchasing directly from us.

7.2 Delivery charges

Delivery charges will be displayed before an order is completed.

Charges may vary according to the products ordered, delivery destination, parcel size and delivery method.

7.3 Delivery estimates

Estimated delivery times will be provided during checkout or in the relevant product information.

We aim to dispatch orders within the stated timeframe.

Delivery estimates may occasionally be affected by postal delays, stock availability or other circumstances outside our reasonable control.

Where no delivery period has been agreed, we will deliver without undue delay and, unless otherwise agreed, within 30 days of the contract being made.

7.4 Delayed or missing orders

If an order is delayed or has not arrived, please contact us.

We will investigate the issue and work towards an appropriate resolution.

Where goods are not delivered within an agreed or legally required period, customers may have the right to cancel and receive a refund in accordance with applicable consumer law.

7.5 Damaged goods

If an item arrives damaged, incorrect or faulty, please contact us with the order details and a description of the problem.

Photographs may help us resolve the matter more quickly, but providing photographs is not a condition of exercising statutory consumer rights.

7.6 International orders

Where international delivery is available, any applicable shipping charges will be shown before checkout.

Customers may be responsible for import duties or local taxes imposed by the destination country, where these have been properly disclosed before purchase.

International orders may be subject to additional delivery times and local customs procedures.

8. Returns, Exchanges and Refunds

8.1 Change-of-mind cancellations

For most physical goods purchased online, customers have a statutory right to cancel within 14 days after receiving the goods, subject to applicable exceptions.

To exercise this right, customers must notify us clearly of their decision to cancel within the relevant period.

Customers then generally have a further 14 days to return the goods.

We will provide the necessary return instructions.

8.2 Returning products

Customers should take reasonable care of goods while they are in their possession.

Where a customer exercises a statutory change-of-mind cancellation right, they may be responsible for the direct cost of returning goods, provided this was communicated before purchase.

Customers may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning.

Where goods have been handled beyond what is reasonably necessary, a lawful deduction may be made for any resulting reduction in value.

8.3 Refund processing

Where a valid statutory cancellation applies, we will refund the payments required by law, including the cost of standard outbound delivery where applicable.

We may withhold a refund for returned goods until they have been received or the customer supplies evidence of having sent them back, where permitted by law.

Refunds will be processed within the applicable statutory deadlines, normally using the original payment method unless otherwise agreed.

8.4 Faulty or misdescribed goods

Products must meet the standards required by the Consumer Rights Act 2015.

If goods are faulty, not as described or otherwise fail to meet statutory requirements, customers may be entitled to a repair, replacement, refund or another remedy depending on the circumstances.

These rights apply independently of the ordinary change-of-mind cancellation policy.

Where goods are faulty or do not conform to the contract, we will meet our legal obligations concerning reasonable return costs.

8.5 Clothing and merchandise

Clothing and other merchandise may be returned in accordance with applicable statutory cancellation rights.

Customers should take reasonable care when trying on clothing.

A reduction in refund value may be permitted where handling goes beyond what would reasonably be allowed when examining an item in a shop.

8.6 Personalised products

Products made to a customer’s individual specifications or clearly personalised may be exempt from the ordinary statutory change-of-mind cancellation right.

Where this exception applies, it will be explained before purchase.

This does not affect statutory rights relating to faulty or misdescribed goods.

8.7 Sealed recordings

Sealed audio or video recordings may be exempt from the statutory change-of-mind cancellation right once unsealed after delivery.

This exception does not remove statutory rights relating to faulty goods.

9. Digital Music and Downloadable Products

We may offer digital music, downloadable recordings, educational materials or other digital content.

Product descriptions will explain the format and any relevant access or compatibility requirements.

9.1 Digital purchases

Digital content will normally be supplied electronically using the delivery method described at checkout.

Customers are responsible for checking that their devices and software meet any stated compatibility requirements.

9.2 Digital cancellation rights

Customers purchasing digital content online may have a statutory cancellation right.

Where digital content is supplied immediately during the cancellation period, the right to cancel may be lost if the customer has given the legally required express consent to immediate supply, acknowledged the resulting loss of cancellation rights and received the required confirmation.

We will not treat a customer’s statutory cancellation right as lost unless the applicable legal requirements have been satisfied.

9.3 Faulty digital content

Digital products must meet applicable statutory standards, including being as described and of satisfactory quality.

Where digital content does not conform to the contract, customers may be entitled to a repair, replacement, price reduction or other statutory remedy.

9.4 Permitted use

Unless otherwise stated, purchased digital music and educational downloads are supplied for personal, non-commercial use.

Purchasing a download does not transfer ownership of the underlying copyright.

Customers must not redistribute or commercially exploit protected digital content without permission, except where permitted by law.

10. Website Accounts

Certain features may require customers or students to create an account.

Where accounts are available, users are responsible for providing accurate information and taking reasonable steps to protect their login details.

Please notify us if you suspect unauthorised access to an account.

We may restrict or suspend access where reasonably necessary to address security concerns, fraud or serious misuse.

Any such action will be proportionate and will not remove statutory rights relating to purchased products or services.

Student Portal accounts may be operated through an external service provider and are also subject to the relevant tuition arrangements.

11. Third-Party Websites and Services

Our website may contain links to external websites or use third-party services, including payment processors, booking platforms and delivery providers.

We do not control the content or operation of independent third-party websites.

Customers should review the relevant third party’s information where appropriate.

However, the use of a third-party provider does not remove our responsibility for obligations that remain ours under a customer contract or applicable law.

12. Reviews and Customer Content

Customers may be able to submit reviews, testimonials, comments or other content.

We ask that contributions are genuine, lawful and respectful.

We may moderate or remove material that is unlawful, fraudulent, abusive, misleading or otherwise inappropriate.

Customers retain ownership of original content they submit.

Where customers provide material specifically for publication on our website, they grant us permission to display it for that purpose, subject to any separate agreement and applicable law.

We will not assume unrestricted commercial ownership of customer photographs, recordings or other original material.

13. Website Availability and Security

We aim to keep our website accessible, accurate and secure.

However, temporary interruptions may occur because of maintenance, technical faults, service-provider issues or circumstances outside our reasonable control.

We may make reasonable changes to website features or functionality.

We will take appropriate steps to protect customer information and address security issues.

Nothing in this section removes liability that cannot lawfully be excluded.

14. Privacy and Personal Information

We collect and process personal information where necessary to operate our website, manage orders, provide services and communicate with customers.

Personal information will be handled in accordance with applicable UK data-protection legislation.

Further information is available in our separate Privacy Policy.

Our Privacy Policy explains the categories of information collected, purposes of processing, relevant service providers, retention arrangements and individuals’ data-protection rights.

Where cookies or similar technologies require consent, we will seek that consent as required by applicable law.

15. Liability and Consumer Protection

We are responsible for providing products and services in accordance with our contractual and legal obligations.

Nothing in these terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of statutory consumer rights where liability cannot lawfully be excluded.
  • Any other matter for which exclusion or limitation of liability is prohibited by law.

We do not seek to exclude liability for losses caused by our breach of contract or negligence where doing so would be unlawful or unfair.

Customers remain entitled to the protections and remedies provided by applicable consumer law.

16. Complaints and Disputes

We aim to resolve customer concerns promptly and fairly.

If you have a complaint about an order, product, lesson booking or website service, please contact us with the relevant details.

We will review the matter and respond within a reasonable period.

Where a dispute cannot be resolved directly, customers retain their rights to pursue available legal remedies.

Nothing in these terms requires consumers to submit to compulsory private arbitration or prevents access to the courts.

17. Changes to These Terms

We may update these Website Terms & Conditions where reasonably necessary to reflect changes to our services, products, website operations or legal requirements.

The latest version will be published on our website.

Changes will not retrospectively alter existing purchases or contracts unless permitted by law or agreed between the parties.

For an existing order, the terms applicable when the contract was formed will normally continue to apply.

18. Governing Law

These terms are governed by the laws of England and Wales.

Customers retain any mandatory consumer protections that apply to them under relevant law.

Nothing in these terms removes any right to bring proceedings before a court that has jurisdiction under applicable law.
